(before checking i did have a looksee using search before i posted this, nothing of this ilk came up)

i obviously know that if you are sampling from a film, tv or a specific tune you have to get sample clearance from the distributor or whoever owns the rights to it….

but there’s some stuff i wanna sample from adult movies. now……these things are very rarely scripted, and even if they are the pieces of ‘dialog’ i want to sample are more reactions to having things put where they really ain’t keen on having things put in certain places, but they had signed the disclaimer anyways. lol.

now….does someone own the rights to these nuggets of sampling fodder? or because said things i want to sample are reactions are they up for grabs?

i have emailed the distributor who owns one of the adult titles that i wanna sample, but they not got back to me yet.

Ooh, not sure about this one, you better send me the movie so I can give a better
informed guess
Its gonna fall under the same umbrella as anything that has been recorded.
Someone owns it.
If I recorded a fart and someone sampled it, as long as I could prove I made the
recording I would be entitled to money made from it.
(What a great example!)

Realistically speaking, its gonna depend on how obscure the sample is and how much
money your gonna make from the final mix.
What are the chances of anyone recognizing the sample?

i probably would be best sampling our lass, in the same ‘situations’ lol

but that would probably open up a whole other legal wrangle. lol

Just wanted to pop in real quick and affirm that the recording, in its entirety, is protected under the copyright laws … including all audio and video and even the titles and credits. Now, just to make sure, send me a copy as well.

a quick update……

i have since received an email from the distributors…..asking how and where i want to use the sample…..not going into too many details…that would just be boring. but they have said there should be no probs using the sample/s. would just like to know my intentions. and they are happy that someone actually cares enough to ask permission. i guess its the old ‘ya don’t ask ya don’t know’ scenario. i’m sure this will not be the case for ALL sample clearance like.

interesting topic. I think the key question was would anyone recognize the sample, I cant see some random porn floozie hearing a song and saying hey wasnt that the noise i made when you… or even the director/producer going hey wasnt that the sound she made when you…
